Blue Audio Comments on Proposed FCC Rule Changes

Rules Relate to Pay-Per-Call Services, Audiotext Information Services and Toll-Free Numbers

SEATTLE, Dec. 8 /PRNewswire/ -- Blue Audio, a subsidiary of Blue Frog Mobile, Inc., is taking issue with proposed Federal Communication Commission rule changes to pay-per-call services, audiotext information services and toll-free numbers.

"These rule changes will not protect consumers, but rather deny people affordable services in the long run," says Jeffrey Moore, President of Blue Audio Inc. "The changes would also hurt small businesses," he added.

Blue Audio opposes the Proposed Rules due to the following reasons:

1. The FCC is not authorized to implement the Proposed Rules without
congressional authority.
2. The Proposed Rules violate the First Amendment to the U.S.
Constitution by imposing an unnecessary burden on people who engage in
conversation and expression.
3. The Proposed Rules would force Blue Audio and other small businesses
out of the market.
4. Consumers would lose the inexpensive and safe form of audiotext and
entertainment because most audioconference providers would be forced
to leave the market, due to cost of implementing changes.



The proposed rules would regulate audioconference services in the same manner as pay-per-call services. Audioconference providers do not offer pay-per-call services as defined by Congress and should not be regulated as such.

"Our customers do not require procedural safeguards any more than any consumer who makes any other regular telephone call to a friend or business colleague," Moore added. Consumers are interested in using audioconference services because the services are inexpensive, entertaining and informative.

The proposed rules would adversely affect minorities and lower income consumers. A substantial number of the U.S. population cannot use -- or choose not to use -- credit cards and thus, would be denied access to important telecommunications services.

If approved, the rules would mean that audioconference services as consumers know them today would virtually be lost forever.
