Kansas International Ltd. is Successful in Having Preliminary Injunction Vacated
SAN JOSE, Calif., Aug. 23 /PRNewswire/ -- Kansas International Ltd. announced this week that the U.S. District Court for Massachusetts has vacated a preliminary injunction that it had previously granted in favor of First Act Inc. The underlying lawsuit concerns alleged infringement of a U.S. Design Patent No. D487,627, covering one specific guitar case design. Kansas also filed counterclaims against First Act for False Advertising, Unfair Deceptive Acts and Patent Invalidity. This lawsuit does not cover guitars or any other products sold by Kansas.
The United States Patent and Trademark Office is currently reviewing a Request for Reexamination of First Act's U.S. design patent (D487,627). New evidence submitted to the USPTO shows that a similar design (used on backpacks) was in existence well before First Act applied for the design patent in question. If the USPTO finds the new evidence to be material, the USPTO may invalidate First Act's design patent.
