WebEx Files Suit Against Citrix for Cybersquatting
Complaint in U.S. District Court Alleges Trademark Infringement, Cybersquatting and Unfair Competition
SANTA CLARA, Calif., Feb. 3 /PRNewswire-FirstCall/ -- WebEx Communications, Inc. (NASDAQ:WEBX) today announced that it has filed a lawsuit against Citrix Systems Inc. (NASDAQ:CTXS) and related parties in the U.S. District Court for the Northern District of California. The complaint asserts claims for trademark infringement, cybersquatting and unfair competition, and alleges that Citrix unlawfully purchased numerous domain names containing WebEx trademarks. The complaint alleges that many of the illegal domain name registrations were purchased on the same day that WebEx launched the new MyWebExPC service at http://mywebexpc.com/ , a service which allows customers to remotely access computers and which competes with Citrix's GoToMyPC products.
WebEx's MyWebExPC services, including MyWebExPC Free and MyWebExPC Pro, were launched on January 24, 2005 as stated in the following press release http://webex.com/pr/pr321.html . The domain names unlawfully purchased by Citrix and identified in the complaint include: webexpc.com, mypcwebex.com, mypcwebx.com, my-webex-pc.com, mywebexpcfree.com, mywebxpcfree.com, mywebexpro.com, mywebxpro.com, mywebexpcpro.com and mywebxpcpro.com.
Citrix earlier had also purchased other domain names containing WebEx's "AccessAnywhere" trademark, which had been previously contemplated as a name for these new WebEx services. The complaint alleges that Citrix has used the domain names in an attempt to illegally divert to Citrix's website potential customers who were attempting to find WebEx's http://mywebexpc.com/ website. The lawsuit seeks injunctive relief to stop the unlawful activity, damages and attorneys fees.
