Ervin Cohen & Jessup LLP Obtains $2.9M in Damages for Music Publishing Client
LOS ANGELES, April 29, 2014 /PRNewswire/ -- After three years of litigation for breach of contract and fraud against large music publishing companies, Ervin Cohen & Jessup's David Tarlow has obtained compensatory damages in the amount of $1,981,671.07 and punitive damages totaling $1M for his client, Sound Oasis Productions LLC.
ECJ Attorney David N. Tarlow served as lead trial counsel for the plaintiff, Sound Oasis Productions, LLC, against the defendants, EMI Music Publishing and Jobete Music Co., Inc., in a dispute amongst co-publishers. The battle centered around the injury suffered by the plaintiff because of defendants' breach of contract and fraud in connection with a domestic co-publishing agreement between the parties and a Settlement Agreement which modified the terms of the domestic co-publishing agreement. The music catalog effected by the breach of contract and fraud was the Grimora Publishing Catalog, which includes the Motown #1 smash hit "Love Machine" by The Miracles. After a three week trial, the jury found in favor of plaintiff on both its breach of contract claim and fraud claim, and awarded compensatory damages against defendants in the amount of $1,981,671.07 and punitive damages in the amount of $1,000,000.00.
